Terms of service
These Terms and Conditions ("Terms") govern all purchases made from Picot & Moss ("the Company"), whether through the Company's boutiques or its online store. By purchasing goods from the Company, the customer ("the Purchaser") agrees to be bound by these Terms.
1. Application of Terms
1.1 These Terms apply to all sales of goods or services by the Company to the Purchaser. 1.2 No variation, waiver, or amendment of these Terms shall be binding unless expressly agreed to in writing by the Company.
2. Online Purchases
2.1 Notification of Defects or Incorrect Supply a. The Purchaser must notify the Company in writing within twenty-four (24) hours of receipt of goods if the incorrect product has been supplied or if the product is defective or damaged. b. The Company reserves the right to reject any claim made outside this notification period.
2.2 Returns and Refunds a. Full details of returns, exchanges, and refunds are set out in the Company's Returns & Refunds Policy, which must be read together with these Terms. b. The Returns & Refunds Policy forms an integral part of these Terms.
3. Delivery and Collection
3.1 Courier Delivery a. All orders are shipped via reputable national courier services. b. Once the Purchaser's parcel has been scanned into the courier's depot, the Purchaser will receive an email notification containing a tracking link. c. Risk in and to the goods shall pass to the Purchaser upon delivery.
3.2 Dispatch Timeframes a. Most items in stock will be dispatched within two (2) to five (5) business days of receiving cleared payment. b. Select items qualify for the 1 Day Dispatch service, meaning the order will be packed and handed over to the courier within one (1) business day of receiving cleared payment. c. If an order contains only items marked with the 1 Day Dispatch label, the entire order will be dispatched within one (1) business day. d. If an order contains a combination of 1 Day Dispatch items and standard items, the full order will be dispatched together within the standard two (2) to five (5) business days timeframe.
3.3 Delivery Exclusions a. Shipping within South Africa only, excluding rural areas.
3.4 Click & Collect a. The Company offers free Click & Collect at the following boutiques: Sandton City (Johannesburg), V&A Waterfront (Cape Town), Gateway (Durban). b. To use this service, the Purchaser must select the "Pickup in Store" option at checkout and provide contact details. c. The selected boutique will contact the Purchaser once the order is ready for collection. d. Risk in and to the goods shall pass to the Purchaser upon collection.
4. In-Store Purchases
4.1 Exchanges shall be permitted within fourteen (14) days of the purchase date, provided that: (a) the goods are unused, in their original condition and packaging; and (b) the original receipt is presented. 4.2 Exchanges may only be effected at the Company's boutiques. Where the desired product is not available, the Company may issue a credit note for future redemption. 4.3 Refunds shall only be granted if the goods are defective, in accordance with section 56 of the Consumer Protection Act 68 of 2008 ("CPA"). 4.4 Refund claims must be lodged within six (6) months of the date of purchase.
5. Limitation of Liability
5.1 To the maximum extent permitted by South African law, the Company shall not be liable for any loss, damage, or claim arising out of: (a) misuse of goods by the Purchaser; (b) unauthorised alterations or modifications to goods; (c) indirect, consequential, or incidental losses. 5.2 Nothing in these Terms shall limit or exclude the Purchaser's statutory rights under the CPA.
6. Governing Law and Jurisdiction
6.1 These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. 6.2 The Purchaser consents to the jurisdiction of the Magistrates' Court in respect of any action arising out of these Terms, notwithstanding that the amount in dispute may exceed the jurisdiction of the Magistrates' Court.
7. Electronic Transactions
7.1 In compliance with the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"): (a) all online transactions shall be deemed valid upon confirmation of payment; (b) records of electronic communications between the Purchaser and the Company shall be admissible as evidence.
8. General
8.1 The Company reserves the right to amend these Terms from time to time. Updated Terms shall be published on the Company's website and shall apply to all transactions concluded thereafter. 8.2 If any provision of these Terms is found to be unlawful, invalid, or unenforceable, such provision shall be severable from the remaining provisions, which shall continue to be valid and enforceable.
